What is the subject of data protection and how is your personal data collected, processed and used on www.cuspcapital.com?

The subject of data protection is personal data. Pursuant to Art. 4 (1) of the General Data ProtectionRegulation, this refers to any information relating to an identified or identifiable natural person. Which security does our website provide?

The technical and organizational security measures implemented by us serve the purpose of protecting the data that you voluntarily provide us with against unconscious or intentional manipulation, loss, destruction or access by unauthorized persons. Cusp Capital continuously develops and improves security measures in line with technological developments.

Your rights as a data subject result from the applicable data protection laws, in particular the General DataProtection Regulation (GDPR). You have the following rights, inter alia, which you may assert against the Controller:

  • Right to obtain information about processed personal data concerning your person pursuant to Art. 15 GDPR;
  • Right to rectification of your personal data pursuant to Art. 16 GDPR;
  • Right to erasure of your personal data pursuant to Art. 17 GDPR;
  • Right to restriction of processing of your personal data pursuant to Art. 18 GDPR;
  • Right to data portability pursuant to Art. 20 GDPR;
  • Right to object to processing your personal data pursuant to Art. 21 GDPR;

If processing is based on consent, you have the right to withdraw your consent at any time in accordance with Art. 7 (3) GDPR, without affecting the lawfulness of processing based on consent before its withdrawal.

You also have the right to lodge a complaint with a supervisory authority (Art. 77 in conjunction with Art. 19of the German Data Protection Act (BDSG)). The supervisory authority responsible for us is the North Rhine-Westphalia State Commissioner for DataProtection and Freedom of Information, Düsseldorf, Germany.

Use of Salesforce

We use the software salesforce by salesforce.com Germany GmbH based in Germany to capture, process, review, and manage external financing requests. By means of salesforce, the information about you and the company which you have provided directly by using the form on our website or by sending an email to admin@cuspcapital.com or an employee of Cusp Capital (in particular name, email, further contact data) will be permanently stored and processed. By submitting the data, you consent to the processing of your data in accordance with this Privacy Policy as well as Art. 6 (1) lit. b DSGVO and the transfer of data to servers of salesforce.com Germany GmbH.

Use of Personio

We use the software Personio by Personio SE & Co. KG based in Germany to capture, process, review, and manage job application processes and job applicant data. By means of Personio, the information which you have provided directly by using the form on our website or by sending an email to jobs@cuspcapital.com or a employee of Cusp Capital (in particular name, email, further contact data) will be digitally stored and processed. By submitting the data, you consent to the processing of your data in accordance with this Privacy Policy as well as Art. 6 (1) lit. b DSGVO and the transfer of data to servers of Personio SE & Co. KG.

Data will be deleted 180 days upon completion of an application process.

Use of Plausible Analytics

On our website we use Plausible Analytics, OÜ Plausible Insights, Västriku tn 2, Tartu 50403, Estland, to track overall trends in the usage of our website. Plausible Analytics collects only aggregated information, which does not allow us to identify any visitor to our website. The processing is carried out in accordance with Art. 6 (1) lit. f DSGVO. Use of Memberstack

On our website we use services provided by Memberstack Inc, 1209 Orange StreetWilmington, New Castle County, Delaware 19801 to provide a login area for our Limited Partners. Memberstack uses Cookies to identify users with credential to access certain restricted sites. The processing is carried out in accordance with Art. 6 (1) lit. f DSGVO on the basis of our legitimate interest in a secure and efficient provision, as well as improvement of the stability and functionality, of our website. Use of cloudworx

On our website we use services provided by cloudworx GmbH, Rupert-Mayer-Straße 44, Gebäude 64.07a81379 München, to provide a data upload functionality for financing requests. cloudworx uses a cookie - which is deleted after 1 day - to identify users during the upload process. The processing is carried out in accordance with Art. 6 (1) lit. f DSGVO on the basis of our legitimate interest in a secure and efficient provision, as well as improvement of the stability and functionality, of our website.

Use of Fastly

On our website we use a so-called Content Delivery Network ("CDN") of the technology service provider Fastly Inc., 475 Brannan St. #300, San Francisco, CA 94107, USA ("Fastly"). A Content Delivery Network is an online service that is used in particular to deliver large media files (such as graphics or page content) through a network of regionally distributed servers connected via the Internet. The use of Fastly's Content Delivery Network helps us to optimize the loading speeds of our website. The processing is carried out in accordance with Art. 6 (1) lit. f DSGVO on the basis of our legitimate interest in a secure and efficient provision, as well as improvement of the stability and functionality, of our website. Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)
